These Terms of Service (“Terms”) govern your access to and use of the OFF DUTY NOT DRIVING REWARDS INC. website, platform, portals, and services (collectively, the “Services”).

By accessing, browsing, registering for, or using our website or Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you may not use the Services.

1. Purpose of the Platform

ODNDR provides a safety engagement and rewards execution platform for the professional trucking industry. Drivers enrolled through participating fleets may earn points based on safety and performance metrics. Those points may be redeemed for merchandise, gear, and services offered through the ODND catalog.

2. Eligibility

You must be at least 18 years old to use the Services.

You represent that you are authorized by your employer or fleet, where applicable, to participate in the rewards program.

3. User Accounts

To access certain features, you may be required to create an account. You agree to:

Provide accurate and current information
Maintain the confidentiality of your login credentials
Notify us immediately of any unauthorized account activity

You are responsible for all activity that occurs under your account.

4. Points Program and Redemption

Points earned through ODNDR have no cash value and may only be used within the platform for reward redemption.

Redemption of rewards is subject to the following conditions:

Availability: Reward items are offered subject to inventory and supplier availability.
Substitution: ODNDR reserves the right, at its sole discretion, to substitute any redeemed item with a product of equal or greater value and comparable type or function when necessary.
Fulfillment: Rewards are fulfilled and shipped directly to the address provided by the user.

ODNDR may modify reward offerings, point values, or fulfillment methods at any time without prior notice.

5. Platform Usage

You agree not to:

Misrepresent your identity or performance data
Interfere with the operation or security of the Services
Attempt to gain unauthorized access to any part of the platform

Any misuse of the platform may result in suspension or termination of your account.

6. Intellectual Property

All content, trademarks, platform logic, and materials on the website are the exclusive property of OFF DUTY NOT DRIVING REWARDS INC. You may not reproduce or use our materials without express written consent.

7. Limitation of Liability

ODNDR provides the Services “as is” and “as available.” We do not guarantee uninterrupted access or error-free operation.

To the fullest extent permitted by law, ODNDR shall not be liable for:

Indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Delays or failures in reward fulfillment caused by suppliers or carriers

Our maximum liability for any claim shall not exceed the value of the reward item redeemed by the user.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. By using the platform, you consent to the collection and use of data as outlined in that policy.

9. Termination

We reserve the right to suspend or terminate any account or user’s access to the Services at our sole discretion for violations of these Terms or misuse of the platform.

10. Modifications to the Terms

ODNDR may update or revise these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Delaware, without regard to conflict-of-law principles.
